Terms & conditions
The terms that govern use of this website and the provision of services by Phyber Mart Financial.
Last updated: July 28, 2026
Agreement to these terms
By accessing this website or engaging Phyber Mart Financial for services, you agree to these terms. If you do not agree with them, please do not use the site or our services.
Services
We provide bookkeeping, tax preparation and strategy, virtual CFO advisory, loan consultation, records cleanup, systems setup and payroll services. The specific services provided to you are defined in a separate written engagement letter, which takes precedence over these terms where the two conflict.
We do not provide audit, attest, legal or investment advisory services, and nothing on this website should be read as an offer to provide them.
Not professional advice
Content on this website is general information only. It is not tax, legal, accounting or financial advice, and it does not take account of your particular circumstances. You should not act on it without obtaining advice specific to your situation. No client relationship is created by reading this website or by submitting an enquiry form — it begins only when a written engagement letter is signed by both parties.
Client responsibilities
The quality of our work depends directly on the completeness and accuracy of what you provide. You agree to:
- Supply complete, accurate and timely records, documents and information
- Notify us promptly of changes to your business, structure or circumstances that affect the work
- Review deliverables we provide and tell us about any error you identify
- Retain the underlying records required by law
- Make the final decision on any position taken in a filing made on your behalf
We are entitled to rely on the information you provide without independently verifying it, unless the engagement letter specifically says otherwise.
Fees and payment
Fees are set out in your engagement letter. Retainer fees are invoiced monthly in advance; project fees are invoiced at agreed milestones. Payment is due within the period stated on the invoice.
We may suspend work on accounts with overdue invoices after written notice. Any additional work outside the agreed scope will be quoted and approved in writing before it is carried out.
Term and termination
Monthly engagements continue until either party terminates with 30 days written notice. Either party may terminate immediately if the other commits a material breach that is not remedied within 14 days of written notice.
On termination you remain liable for fees for work performed up to the termination date. We will return your records and provide a reasonable handover to your incoming provider.
Confidentiality
We treat all client information as confidential and will not disclose it except as needed to deliver the services, as permitted in our privacy policy, or as required by law or a regulatory authority.
Intellectual property
All content on this website — text, design, graphics, logos and code — is owned by Phyber Mart Financial or its licensors and is protected by applicable intellectual property law. You may view and print pages for your own reference. You may not copy, republish, or use our content or branding for commercial purposes without written permission.
Working papers, templates and models we create in the course of an engagement remain our property. Your own records and the finished deliverables prepared for you are yours.
Limitation of liability
To the fullest extent permitted by law, our total liability arising out of or in connection with the services is limited to the fees paid by you to us for the specific service giving rise to the claim in the 12 months preceding it.
We are not liable for indirect, incidental, consequential or punitive losses, including lost profits, lost business or lost data. We are not liable for penalties or interest arising from information that was incomplete, inaccurate or provided late by you, or from a position you instructed us to take against our advice.
Nothing in these terms limits liability for fraud, or for any other liability that cannot lawfully be limited.
Third-party links
This website may link to third-party sites. We do not control them and are not responsible for their content, accuracy or privacy practices.
Governing law
These terms are governed by the laws of the State of Texas, United States, and the courts of that state have exclusive jurisdiction over any dispute arising from them.
Changes
We may update these terms from time to time. The revision date above reflects the current version. Continued use of the website after changes are posted constitutes acceptance of them.
